The answer is false. This is a 4 part question and of which all parts are false.
First, no one in any type of case can be found Innocent. In a criminal case a defendant can be found guilty or not guilty. There is no Innocent verdict.
Second, a plaintiff cannot be found guilty or not guilty, he or she is bringing the compliant, his or her guilt is not being adjudicated by the court. only a defendant can be found guilty or not guilty.
Third, by using the term plaintiff, you can assume this is a civil case. There is not a plaintiff in a criminal case, all criminal cases are brought by a prosecutor. In a civil case the defendant is found liable or not liable. Again, there is no adjudication of guilt in a civil proceeding, only in criminal proceedings.
Fourth, summary judgment is a motion for which the judge will decide a case by matter of law, i.e., there are no issues of material fact in dispute and there is only one reasonable outcome based on the facts accepted by the court. However, summary judgment can go in favor of either party. Meaning your could have a summary judgment in favor of the plaintiff or the defendant. Therefore, it is not an automatic verdict for the plaintiff.
